As I read the ongoing articles and stories about the travails of the Amish in Morristown N.Y. The thing that keeps coming at me, is how so many of the posts are missing the forest from the trees, in my opinion.
We have become such a society of conformist, there is not support for individualism! At least not of the substance to matter in a democracy.
The first amendment, was designed to protect just that individualism, but has been totally thwarted, all in the name of Public Safety!
The issue is largely one of Government control of the populate. Today, we are totally at the beck and call of the government. This situation has evolved through the laziness of the populate accepting the liberal philosophy, the government can do it all for you. Any person with their eyes open can see how well that is working, and has worked for the past 40 years.
To get back to the Amish religion, which our government is suppose to be 'Protecting", it is clear the Amish don't have allot of confidence in that happening.
They comprise a small minority of the population as well as its predominant religious beliefs. Therefore, their liberty is expendable because those who expend it are in no danger of the only recourse available, the vote. With that hurdle past, and the only thing left to consider is whether the ideals of our constitution or the ideals of government control are to be protected, by the decisions of those in power.
Obviously, you can see where this is going, it is going to be in favor of government. First of all, this bias, leads to more government and its associated easy good paying jobs. Also, to stand up against the stream for the sake of the protection of the few, is one which requires personal courage, which I don't find prevalent in those that hold government power.
It is easy to see by following the Morristown case, the local Judge is making decisions which are in the best interest of "Morristown". When Ballan asked Judge Richards to accept the case, you can see how that worked out. And that brings us to the Money Trail, which where Ballan ends, being presently paid by the public, but soon to end if the case can be transferred to State Supreme court. This is where the Judicial system is even structured to prevent the few from Justice. It is the 'laws' the government uses to control its populate. And who has control over the laws, the lawyers and the Judges. If either of the two is taken out of the equation the power fails. Who makes up our leaders, The elite, not the common man. The very few common men who have made it into the system, have soon to remove themselves after realizing how powerless they are against the tide. Jesse Ventura is a classic example. When running, the populate was all for him. After success, he soon found he was totally ineffectual, due to the positioned allegiance of those before him.
As long as Justice, is dependent on Money, it is going to be only for those who have it! This is not the intention of the founding fathers. As soon as the common man, enters the courtroom en mass, we will continue down this road of endless liberal protectionism of our Rights!
The Amish will not fight their own legal battles, but will allow the public defender to. The courts and their structure no exactly how to stop Ballan and thereby comes the end of another story of individualism. All of this for nothing!
The public at large have been oppressed and led down the road of subservience so long there is no support from them. It's the old, "well I had to do it, so they have to too". Instead of " well I did do it, but it wasn't right, and they shouldn't have too". So I will stand with them, despite the fact that I might have acquiesced.
The first Amendment, is a Right, and as long as it is qualified, diced, interpreted, parsed and adjudicated by those elite in power, the common man is doomed. The only answer, is for the common man, to rise up en mass and support the Right, not the individual or his belief. It has been said a thousand times before, "I disagree with you, but will fight to the death, for your "RIGHT" to say it". If the common man populate would adopt this philosophy to "all' the rights we would have less, "laws" and more freedom! And oh yes, their would be some few, who would get hurt in the process. I forget which founding person it was who said it, but it was something basically like this. When we esteem protection at the sake of liberty, we have sold ourselves and the country short.
This is exactly where we are today, as I see it there are two scenario's. One we will come to our collective senses, rise up against the liberal onslaught that government will fix everything for us. Or we will continue down the beaten path until our Nation demise is FAILURE!
